Act of settlement 1781 UPSC

Here we will study Act of settlement 1781 (UPSC) from the viewpoint of UPSC exams and other State PSC exams. This act was passed by British Parliament to correct the defects of the regulating act of 1773. This act is also known as Act of settlement or Amending act of 1781 or Settlement act of 1781.

Salient features of act of settlement 1781 (UPSC)-

The main reason behind the introduction of Amending act of 1781 was to demarcate the jurisdiction of governor general of Bengal and his Council from the jurisdiction of the supreme court of Calcutta.

Act of settlement 1781 rectified the defects of Regulating act of 1773 . Some of the features of this act are-

  • It exempted the governor general and the Council from the jurisdiction of the Supreme court of Calcutta for the acts done by them in their official capacity.
  • Servants of Company were also exempted from Supreme court of Calcutta jurisdiction for their works.
  • Revenue matters and revenue collection matters were also exempted from Supreme court of Calcutta jurisdiction.

  • Supreme court of Calcutta was given jurisdiction over inhabitants of Calcutta.

  • Supreme court of Calcutta was made to administer personal law of the defendants.
  • Hindus had to be tried according to Hindu law and Muslims according to Muslim law.
  • Now appeals from provincial courts had to be taken to governor general in Council and not to Supreme court of Calcutta. It reduced the appellate jurisdiction of Supreme court of Calcutta.
  • Governor general and Council was given power to frame regulations for provincial Courts and councils.

These were the important facts of the Amending act of 1781. These points are very important from the viewpoint of our UPSC and other state PSC exams.
